Fire Risk Assessments

Section 9 of the Regulatory Reform (Fire Safety) Order 2005 (referred to as ‘RRO’ or ‘FSO’) confirms that the ‘Responsible Person’ must make a suitable and sufficient Fire Risk Assessment. In relation to a workplace, the employer is considered the Responsible Person, if the workplace is to any extent, under his control.

As the Fire Risk Assessment and the legislation can be quite technical, the Responsible Person can hire a professional to undertake the Fire Risk Assessment on their behalf.

How we conduct our Fire Risk Assessment

Once instructed, our consultants will attend your workplace to conduct the Fire Risk Assessment.

Stage 1: Information gathering

Once we arrive at your workplace, we will conduct a walk around, paying particular attention to fire escape routes, smoking areas, fire extinguisher points, emergency call point locations, emergency lighting (what else). By looking at the information gathered, we will be able to identify any deficiencies, and look at the controls which will apply.

Stage 2: Risk Assessment Creation and follow-up

Once we have the relevant information, we will produce the Fire Risk Assessment, along with the appropriate controls which need to be implemented. A follow-up meeting can be arranged if this is what you would like, to go through the findings of the Fire Risk Assessment.

Who is a ‘responsible person’?

In relation to a workplace, the employer is considered the responsible person, if the workplace is to any extent under his control.

In relation to any premises, other than workplaces:

  • The person who has control of the premises (as occupier or otherwise) in connection with the carrying on by him of a trade, business or other undertaking (for profit or not); or
  • The owner, where the person in control of the premises does not have control in connection with the carrying on by that person of a trade, business or other undertaking.

Who is responsible for completing a fire risk assessment?

The responsible person is responsible for ensuring that a Fire Risk Assessment that is completed for the premises.

How often should I review a Fire Risk Assessment?

The Fire Risk Assessment must be reviewed by the responsible person regularly so as to keep it up to date, particularly if:

  • There is a reason to suspect that it is no longer valid; or
  • There has been a significant change in the matters to which it relates, including when the premises, special, technical and organisational measures, or organisation of there work, undergo significant changes, extensions or conversions.
